This Privacy Policy describes how Motionik LLC ("Motionik," "we," "us," or "our") collects, uses, discloses and protects information when you use the Motionik desktop application, web application and related services (collectively, the "Service").

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, do not use the Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings defined below. Definitions apply regardless of whether terms appear in singular or plural form.

1.2 Definitions

  • Account means a unique account created for you to access the Service or parts of it.
  • Application refers to Motionik, including the desktop application and web application.
  • Company (referred to as "we," "us," or "our") refers to Motionik LLC, Gould St Ste N, Sheridan, WY 82801, USA.
  • Content or User Content means any recordings, videos, images, audio, text, comments or other materials you upload, create, share or store through the Service.
  • Device means any device that can access the Service, such as a computer, phone or tablet.
  • Personal Data means any information that relates to an identified or identifiable individual.
  • Service refers to the Motionik desktop application, web application and related services.
  • Service Provider means a third party that processes data on our behalf to help us operate the Service.
  • Usage Data means data collected automatically, either generated by use of the Service or from Service infrastructure.
  • Viewer means a person who accesses a shared link to view User Content, whether or not they have a Motionik account.
  • Organization means the top-level billable entity on a Cloud Subscription — the account that has members, seats and a subscription.
  • Workspace means a logical content grouping inside an Organization. Each Organization can have multiple Workspaces.
  • Seat means an active member of an Organization on a Cloud Subscription.
  • You means the individual or legal entity using the Service.

2. Scope of This Policy

Motionik offers two parallel product tiers and the data we collect differs significantly between them:

  • Free Tier (desktop, local only): No account. Recordings stay on your device. We collect only minimal telemetry (see Section 4.4).
  • Lifetime Plan (desktop, local only): License-key based, no account. All recordings, editing history and preferences stay on your device.
  • Cloud Subscription (desktop + web): Account-based. When you sign up, upload content or use the web application, we collect account data, content metadata organization and Workspace data and usage data (see Sections 4 and 5).
  • Viewers of shared content: When someone views content shared from a Cloud Subscription, we collect limited technical data about the viewer (see Section 5).
  • Website visitors: Browsing motionik.com involves standard web analytics cookies (see Section 15).

If you are a Free Tier or Lifetime Plan user and never sign up for a Cloud Subscription, most of this Policy does not apply to you. We do not collect your recordings, editing history or personal information beyond what is described in Section 4.4 (local app telemetry).

3. What's New

Previously, Motionik was a purely local desktop application: all recordings, editing history and preferences were stored on your device and never transmitted to our servers. That remains true for the Free Tier and the Lifetime Plan.

With the introduction of the Cloud Subscription, which adds a web application, cloud uploads, sharing organizations and Workspaces, we now collect and store additional data only for Cloud Subscription users, including uploaded content, account information and related metadata on our infrastructure. This Policy has been updated to reflect those changes.

4. Information We Collect

We collect different information depending on which tier of the Service you use. This Section is organized by tier for clarity.

4.1 Information collected from all desktop app users (Free Tier and Lifetime Plan)

If you use the desktop application without a Cloud Subscription, we collect only the following limited data:

Telemetry and analytics (if enabled):

  • App version and update check requests
  • Operating system and OS version
  • Device type and hardware identifiers (for diagnostic purposes)
  • Crash reports and error logs
  • Anonymous or pseudonymous usage events (e.g., feature used, recording started) via PostHog.
  • Email address (associated with license key)
  • IP addresses

These signals help us diagnose issues, prioritize features and understand product usage in aggregate. We do not collect the content of your recordings, your editing history, your local files or the content of your screen through this telemetry.

Where applicable, you may be able to disable or limit analytics from within the application's settings. If you are in a jurisdiction that requires consent for analytics, we will request consent before collecting non-essential telemetry.

License validation (Lifetime Plan only):

License validation requests are sent to our server, which proxies them to license API. The actual validation decision is made by license API. Our proxy may logs the masked key, IP address and timestamp of each validation request for abuse prevention and diagnostics. We do not receive or store the content of your recordings, files or any other data from your device through this process.

Purchase and support:

  • If you purchased the Lifetime Plan, Lemon Squeezy holds your purchase record, including email address, billing country and payment metadata.
  • If you contact us for support, we process the information you provide in your support request (e.g., email, subject, message, attachments).

What we do NOT collect from Free Tier or Lifetime Plan users:

  • Your recordings (they stay on your device)
  • Your editing history (stays on your device)
  • Your local preferences and settings (stored on your device)
  • Any content of what you record, including screen, webcam or audio

4.2 Additional information collected from Cloud Subscription users

If you sign up for a Cloud Subscription (either via the desktop app's cloud features or via the web application), we collect the following in addition to the data described in Section 4.1.

Account information:

  • Name
  • Email address
  • Password (stored in hashed form; we cannot see your plain-text password)
  • Profile information (e.g., profile picture, if you provide one)
  • Company information (optional)

Organization and Workspace data:

  • Organization name, logo (if uploaded) and settings
  • Workspace names, structure and settings
  • Member lists, roles, seat counts and invitation records
  • Organization and Workspace-level preferences

User Content you upload or create:

  • Video recordings, audio and images uploaded to the cloud
  • Thumbnails (generated automatically)
  • Titles, descriptions, tags and other metadata you provide
  • Comments, reactions or other content you submit (if applicable)

Payment information:

  • We do not store full credit card details. Payments are processed by Lemon Squeezy. We receive confirmation of payments, subscription status, billing address information (country/region for tax) and payment method metadata (e.g., last 4 digits, card brand) from the payment processor.

Cloud usage data:

  • IP address (at the time of login, upload or action)
  • Browser type and version (web application)
  • Device type, operating system and OS version
  • Unique device identifiers
  • Pages and screens visited in the web app
  • Actions taken in the cloud Service (e.g., uploads, shares, member invites)
  • Referring URLs
  • Timestamps
  • Error and diagnostic data

Recording metadata (for uploaded recordings):

  • Resolution, duration, file size
  • Format and codec
  • Creation date
  • Device and OS used to record (technical metadata only, not the content)

Communications:

  • Support requests, feedback and other correspondence
  • Survey responses
  • Responses to marketing emails (if you opt in)

4.3 Information from third parties

  • Payment provider (Lemon Squeezy): Purchase, subscription status, billing metadata, country/region, transaction records and (for Lifetime Plan) license validation events.
  • Authentication providers (if you sign in with a third-party provider such as Google): Your name, email, profile picture and a unique identifier, subject to your consent at the provider.
  • Support and feedback tools (e.g., Featurebase): Feedback, feature requests and related metadata.

4.4 Data that stays local (never transmitted to us)

The following data remains on your device and is not transmitted to our servers, regardless of tier:

  • Recordings not uploaded to the cloud
  • Editing history for local recordings
  • Local application preferences and settings
  • Local project files and session state
  • Content of your screen, webcam or microphone during recording

For Cloud Subscription users, data becomes subject to Sections 4.2 and 4.3 only when you explicitly upload content or take an action that requires transmission to our servers.

5. Information Collected from Viewers of Shared Content

This Section applies only to content shared through the Cloud Subscription. The Lifetime Plan and Free Tier do not include sharing features.

When someone views User Content that has been shared (via public link or via Organization/Workspace access), we may collect:

  • IP address
  • Approximate location (country, region, city) derived from IP address
  • Device type, browser and operating system
  • Referring URL
  • Watch time and interaction data (e.g., when playback starts, pauses, ends)

This data is used to:

  • Provide viewing analytics to the uploader (in aggregated or anonymized form where reasonable)
  • Detect and prevent abuse, fraud and security threats
  • Operate and improve the Service

If you are a viewer and do not have a Motionik account, this Privacy Policy still applies to you with respect to the data we collect from your visit.

6. How We Use Your Information

We use your information to:

  • Provide the Service: Host and deliver your recordings, process uploads, generate thumbnails, transcode videos, render shared links and operate Organization and Workspace features.
  • Manage accounts organizations and Workspaces: Authenticate users, manage memberships and seats, apply permissions and provide account features.
  • Process payments: Bill for subscriptions and manage renewals and cancellations via Lemon Squeezy.
  • Communicate with you: Send transactional emails (invites, password resets, billing notices, security alerts, service announcements), respond to support requests and, with your consent, send marketing emails.
  • Provide analytics to users: Give uploaders insight into how their shared content is being viewed.
  • Improve the Service: Analyze usage trends, diagnose issues and develop new features.
  • Ensure security and prevent abuse: Detect fraud, unauthorized access and violations of our Terms.
  • Comply with legal obligations: Meet our tax, accounting and legal requirements and respond to lawful requests.
  • Enforce our Terms: Investigate and address breaches of our Terms of Service.

If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases under the GDPR and UK GDPR:

  • Performance of a contract: To provide the Service you signed up for (account, uploads, sharing organization and Workspace features, billing).
  • Legitimate interests: To secure the Service, prevent abuse, analyze usage, communicate with users about the Service and develop new features.
  • Consent: For optional marketing emails, certain analytics and advertising cookies and any other processing requiring consent. You may withdraw consent at any time.
  • Legal obligation: To comply with applicable laws, including tax, accounting and law enforcement requests.

8. How We Share Your Information

We do not sell your personal information.

We share information in the following limited circumstances:

We maintain agreements with these providers requiring them to handle your data in accordance with applicable privacy laws and only for the purposes we authorize.

8.2 Within Organizations and Workspaces

If you join an Organization, your name, email, profile information and activity may be visible to:

  • The Organization Owner and admins (who can see all content across all Workspaces within the Organization).
  • Other members of any Workspace you belong to, according to that Workspace's settings and roles.

Members who do not belong to a specific Workspace cannot see content inside that Workspace, except that the Organization Owner and admins retain access to all Workspaces within their Organization.

8.3 When You Share Content

When you share User Content via a public link or with members of an Organization or Workspace, the content becomes accessible to those you share it with. Public links are accessible to anyone with the URL.

We may disclose your information if we believe in good faith that it is necessary to:

  • Comply with a legal obligation, court order, subpoena or lawful request by public authorities.
  • Protect and defend our rights, property or safety or that of our users or the public.
  • Detect, prevent or investigate fraud, security issues or violations of our Terms.

8.5 Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy or sale of all or part of our assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

We may share your information for other purposes with your explicit consent.

9. International Data Transfers

We are based in the United States and our Service Providers may be located in the United States and other countries. When you use the Service, your information may be transferred to, stored in and processed in countries other than your own, including countries that may not offer the same level of data protection as your jurisdiction.

For users in the EEA, UK or Switzerland: we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) where required and we work with Service Providers that commit to equivalent data protection standards.

10. Data Retention

We retain your personal data only for as long as necessary to provide the Service and for the purposes described in this Policy.

We may retain information longer where legally required, to resolve disputes or to enforce our agreements.

11. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Rectification: Request correction of inaccurate or incomplete data.
  • Deletion (right to be forgotten): Request deletion of your personal data, subject to legal retention requirements.
  • Restriction: Request that we limit how we process your data.
  • Objection: Object to processing based on legitimate interests or for direct marketing.
  • Portability: Request a copy of your data in a machine-readable format or request that we transfer it to another provider where technically feasible.
  • Withdraw consent: Where we rely on consent, withdraw it at any time.
  • Lodge a complaint: With a data protection supervisory authority in your jurisdiction.

You can exercise many of these rights directly in the Service (e.g., updating your profile, downloading your recordings, deleting your account). For other requests, contact us at [email protected]. We will respond within the timeframe required by applicable law (typically 30 days).

12. Security

We take the security of your data seriously. Measures we implement include:

  • Encryption in transit: All communications with the Service use TLS (HTTPS).
  • Encryption at rest: Uploaded content is encrypted at rest on Cloudflare and/or AWS.
  • Access controls: Internal access to user data is restricted to authorized personnel on a need-to-know basis.
  • Password protection: Passwords are stored as salted hashes, not in plain text.
  • Monitoring: We monitor for unusual activity, unauthorized access attempts and other security events.

No system is 100% secure. While we use commercially reasonable measures to protect your data, we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

13. Data Breach Notification

In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, we will notify affected users and, where applicable, supervisory authorities, within the timeframes required by applicable law (for example, within 72 hours under the GDPR).

14. Children's Privacy

The Service is not directed to children under 13 (or under 16 in certain jurisdictions that require parental consent at that age). We do not knowingly collect personal data from children under these ages. 15. Cookies and Tracking Technologies

We use cookies and similar technologies (such as local storage and session storage) to operate the Service, remember your preferences, analyze usage and secure your session.

You can control cookies through your browser settings. Blocking strictly necessary cookies may prevent parts of the Service from functioning.

If you are in a jurisdiction that requires cookie consent (e.g., EU, UK), we will present a cookie banner allowing you to accept or reject non-essential cookies.

16. Do Not Track

Some browsers offer a "Do Not Track" (DNT) signal. There is no industry-standard response to DNT signals and we currently do not respond to them. We do, however, honor cookie consent choices where applicable.

The Service may contain links to third-party websites that we do not operate or control. We are not responsible for the content or privacy practices of those sites. We encourage you to review the privacy policies of any third-party sites you visit.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page.

For material changes, we may provide additional notice (such as email or a prominent notice on the Service) before the changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
